These Terms & Conditions ("Terms") govern your access to and use of safalhospitality.com (the "Website") and any services provided by Safal Hospitality and Maintenance Services ("Safal Hospitality", "we", "us", "our"). By using the Website or engaging our services, you accept these Terms in full. If you disagree with any part, please do not use the Website or our services.
1. Definitions
- Services — facility management, housekeeping, payroll outsourcing, pest control, manpower, gardening, event housekeeping and any other services offered by Safal Hospitality.
- Client — the person, firm or company engaging our Services under a written or verbal agreement.
- Visitor — any person browsing the Website without engaging Services.
- Service Agreement — the specific contract executed between Safal Hospitality and the Client governing service delivery, scope, pricing and SLAs.
2. Use of the Website
You agree to use the Website only for lawful purposes. You will not:
- Attempt unauthorised access to any part of the Website, server or database
- Use automated tools (scrapers, bots) to harvest content beyond what is permitted by robots.txt and llms.txt
- Submit false, misleading or fraudulent information through any form
- Upload or transmit malicious code, viruses or harmful material
- Reverse-engineer, decompile or disassemble any part of the Website
- Use the Website in a way that breaches Indian law, infringes intellectual property or causes harm to any third party
3. Intellectual Property
All content on the Website — text, images, logos, graphics, videos, downloads, design and source code — is the property of Safal Hospitality or its licensors and is protected by Indian and international copyright, trademark and intellectual property laws.
You may view, browse and print Website content for personal, non-commercial reference. You may not reproduce, distribute, modify, create derivative works of, publicly display or commercially exploit any content without prior written consent from Safal Hospitality.
"Safal Hospitality" and the Safal logo are trademarks. Unauthorised use is prohibited.
4. Enquiries, Quotes & Service Agreements
Submission of a contact form, quote request or enquiry constitutes an expression of interest only and does not create a contract. Services are provided strictly under a written Service Agreement signed by both parties, which will govern:
- Scope of services and deliverables
- Pricing, payment terms and invoicing schedule
- Service Level Agreements (SLAs), KPIs and performance metrics
- Term, renewal and termination provisions
- Confidentiality, data protection and statutory compliance
- Indemnity, insurance and liability allocation
Quotations are valid for 30 days from issue unless otherwise stated. Pricing is subject to revision based on site visit, scope finalisation and applicable taxes (GST).
5. Pricing & Payment
- All prices are in Indian Rupees (INR) unless otherwise stated
- GST is charged additionally at applicable rates
- Payment terms (advance, milestone, monthly billing) are specified in the Service Agreement
- Late payments may attract interest at 18% per annum from the due date
- Disputed amounts must be raised within 7 days of invoice receipt
6. Service Delivery & Standards
Safal Hospitality undertakes to deliver Services with reasonable care, skill and diligence in accordance with industry standards (NABH for hospitals, GMP for pharma, HACCP for food units, ISO/EHS for industrial facilities, as applicable). Specific SLAs and quality standards are documented in the Service Agreement.
Service delivery may be affected by force majeure events including natural disasters, government orders, civil unrest, epidemics, strikes or any cause beyond reasonable control. We will use commercially reasonable efforts to mitigate impact.
7. Client Obligations
Clients agree to:
- Provide safe, accessible site conditions for our personnel and equipment
- Provide accurate information about scope, locations and operating environment
- Pay invoices within agreed timelines
- Not solicit or hire Safal Hospitality personnel directly during the contract term and 12 months thereafter without prior written consent
- Notify any service issues in writing within reasonable time so we can investigate and remediate
8. Confidentiality
Both parties agree to keep confidential any non-public business, technical, commercial or operational information shared during enquiry, evaluation or service delivery. This obligation survives contract termination by 3 years.
9. Disclaimers
Website content is provided "as is" for informational purposes. While we strive for accuracy, we make no warranty regarding completeness, timeliness or fitness for any specific purpose. Service descriptions are indicative; actual scope is determined in the Service Agreement.
The Website may include links to third-party sites for convenience. We do not endorse and are not responsible for third-party content or practices.
10. Limitation of Liability
To the maximum extent permitted by law:
- Safal Hospitality is not liable for indirect, incidental, consequential, punitive or special damages including loss of profit, business, goodwill or data
- Our total aggregate liability under any Service Agreement is limited to the fees paid by the Client to Safal Hospitality in the 6 months preceding the claim
- Nothing in these Terms limits liability for fraud, gross negligence or wilful misconduct
11. Indemnity
You agree to indemnify, defend and hold harmless Safal Hospitality and its directors, employees and contractors from any claims, losses, liabilities, damages or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of any third-party rights.
12. Termination
Service Agreements may be terminated as per the notice provisions in the agreement. We reserve the right to suspend or terminate Website access for any user violating these Terms, with or without notice. Termination does not relieve the Client of payment obligations for Services rendered up to the termination date.
13. Privacy
Your use of the Website is also governed by our Privacy Policy, which forms part of these Terms by reference. Please review it carefully.
14. Governing Law & Jurisdiction
These Terms and any Service Agreement are governed by the laws of India. Any dispute, controversy or claim arising out of or relating to these Terms or any Service Agreement shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India.
Parties may attempt amicable resolution through mutual discussion or, where applicable, mediation/arbitration as per the Arbitration and Conciliation Act, 1996, before approaching the courts.
15. Changes to These Terms
We may revise these Terms periodically. The "Last Updated" date at the top reflects the most recent change. Continued use of the Website after changes constitutes acceptance. Material changes affecting active Service Agreements will be communicated to the Client.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
17. Entire Agreement
These Terms, together with any executed Service Agreement and our Privacy Policy, constitute the entire agreement between you and Safal Hospitality regarding use of the Website and our Services, superseding all prior representations or understandings.
